Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the SpareSouq mobile application and related services (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform. SpareSouq reserves the right to modify these Terms at any time. Continued use of the Platform following any changes constitutes your acceptance of the revised Terms.

2. Platform Description

SpareSouq is a multi-vendor marketplace that connects buyers, sellers, and automotive workshops in the Kingdom of Bahrain. The Platform enables the buying and selling of automotive parts, accessories, and related services. SpareSouq acts as an intermediary and does not own, manufacture, or directly sell any products listed on the Platform.

3. Account Registration

• You must be at least 18 years of age to create an account
• Registration requires a valid Bahrain mobile number (+973) for OTP verification
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to provide accurate and complete information during registration and to keep it updated
• One account per person. Multiple accounts may be suspended without notice

4. User Roles & Responsibilities

4.1 Buyers

• Buyers may browse, search, and purchase auto parts listed on the Platform
• Buyers are responsible for verifying part compatibility with their vehicle before purchasing
• Buyers must provide accurate delivery addresses within the Kingdom of Bahrain
• Buyers agree to accept and pay for items they have ordered

4.2 Sellers (Vendors)

• Sellers must apply and be approved before listing products on the Platform
• Sellers are responsible for the accuracy of product listings, including descriptions, pricing, condition (new, used, or refurbished), and vehicle fitment information
• Sellers must fulfill orders promptly and maintain accurate inventory levels
• Sellers agree to a platform commission of 10% on each completed sale, which is deducted from the order total
• Sellers must not list counterfeit, stolen, or prohibited items

4.3 Workshops

• Workshops may list both parts and services on the Platform
• Workshops must hold valid commercial registration in the Kingdom of Bahrain
• Workshops are subject to the same commission structure and listing requirements as sellers
• Workshops providing installation services are responsible for the quality and safety of their work

5. Pricing & Currency

• All prices on the Platform are listed in Bahraini Dinar (BHD) with three decimal places (e.g., BHD 12.500)
• Prices are set by individual sellers and may vary between sellers for the same part
• SpareSouq does not control or guarantee the pricing of items listed by sellers
• Prices are inclusive of the stated amount and do not include delivery fees, which are calculated separately

6. Orders & Payments

• When you place an order containing items from multiple sellers, it will be split into separate sub-orders, each fulfilled independently by the respective seller
• Payment is processed securely through Tap Payments, supporting credit/debit cards and BenefitPay
• An order is confirmed only after successful payment authorization
• SpareSouq does not store your full payment card details. All payment data is handled by Tap Payments in compliance with PCI DSS standards
• Order confirmation and status updates will be sent via push notification and are available in the app

7. Delivery

• Delivery is available across the Kingdom of Bahrain
• Delivery timelines are estimates and may vary based on seller location and product availability
• Sellers are responsible for packaging items securely and arranging delivery or pickup
• Buyers must inspect items upon delivery and report any damage or discrepancies within 24 hours

8. Returns & Refunds

• Returns are accepted within 7 days of delivery for items that are defective, damaged during shipping, or significantly different from the listing description
• Items must be returned in their original condition and packaging
• Used or installed parts are not eligible for return unless they are confirmed defective
• Refunds will be processed to the original payment method within 5-10 business days after the return is approved
• SpareSouq will mediate disputes between buyers and sellers. Our decision in such disputes is final
• Delivery fees are non-refundable unless the return is due to seller error

9. Prohibited Conduct

You agree not to:

• List counterfeit, stolen, or illegally obtained auto parts
• Provide false or misleading product information or vehicle fitment data
• Manipulate reviews, ratings, or search results
• Use the Platform for any unlawful purpose or in violation of Bahraini law
• Attempt to circumvent the Platform to conduct transactions directly with other users to avoid commission
• Harass, threaten, or abuse other users through the messaging system
• Create multiple accounts or transfer your account to another person
• Reverse engineer, decompile, or attempt to extract the source code of the Platform

10. Intellectual Property

The SpareSouq name, logo, and all related branding, designs, and content are the intellectual property of SpareSouq. You may not use, reproduce, or distribute any SpareSouq intellectual property without prior written consent. Sellers retain ownership of their product images and descriptions but grant SpareSouq a non-exclusive license to display them on the Platform.

11. Limitation of Liability

• SpareSouq is a marketplace platform and does not guarantee the quality, safety, legality, or accuracy of items listed by sellers
• SpareSouq is not liable for any damages arising from transactions between buyers and sellers, including but not limited to defective parts, installation damage, or vehicle damage
• SpareSouq's total liability shall not exceed the amount of commission earned on the disputed transaction
• SpareSouq does not guarantee uninterrupted or error-free operation of the Platform

12. Account Suspension & Termination

SpareSouq reserves the right to suspend or terminate any account that violates these Terms, engages in fraudulent activity, or poses a risk to other users or the Platform. Suspended sellers will forfeit any pending commission payouts for disputed transactions. You may deactivate your account at any time by contacting support.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Kingdom of Bahrain. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain.

14. Modifications to Terms

SpareSouq reserves the right to modify these Terms at any time. Material changes will be communicated via push notification or in-app notice. Your continued use of the Platform after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
